The District has reached agreements with the San Diego Education Association over situations that may occur as a result of teacher layoffs due to the District reduction in force. Here are some general guidelines related to two of the possible situations:
Additional Workdays
The 14 work days in July 2008, which are part of the year-round school curriculum work year, may have been interrupted by the layoff of certificated personnel that took place on July 1, 2008.
- Both the District and the San Diego Education Association encouraged teachers to complete their instructional assignments and work the remaining days in July 2008.
- It is the teacher’s choice whether or not to work those additional days. The right to recall to future full-time positions will not be affected by that choice.
- Teachers were informed by June 27, 2008, of the opportunity to work the 14 days, and had 24 hours of weekday time to decide.
- If there were opportunities to work the 14 remaining days after all year-round laid off employees made their choices, the district offered the opportunity to laid off teachers not working in year-round assignments. The opportunity was based upon seniority, credential status and NCLB compliance.
- Teachers working the 14 day time period will be paid their daily (pro rata) rate based on their 2008-09 rate of pay.
- Teachers working the 14 days are able to use one day of previously accrued sick leave or personal necessity during the 14-day work period. Payroll will be providing a communication to timekeepers.
- Contributions to CalSTRS will continue to be made for those employees working the 14 days, as required by applicable law.
Packing and Moving
Teachers who were laid off will receive pay and packing/moving assistance.
- Laid off teachers will be paid two days of pay at the visiting teacher rate as compensation for packing and moving outside of the six hour, 35 minute on-site work day.
- Laid off teachers may pack/move on non-contract days, including Saturdays or Sundays, or after the end of their six hour, 35 minute on-site work day. If a teacher chooses to use this time, it should be scheduled with the principal or site supervisor with access to the classroom or workspace granted.
- With the exception of Saturdays, Sundays and holidays, site and district custodial assistance will be made available on the authorized dates and times to the fullest extent possible. - Laid off teachers may store personal belongings and materials related to instruction in a classroom or other enclosed permanent structure. Teachers who choose to store items will be notified in writing where their materials are being stored. The teacher will sign and date an inventory list (number of boxes being stored), which will be verified by the principal or supervisor and provided to the district. Reasonable requests for access to stored materials will be granted. Teachers will be able to store materials until August 22, 2008.
- Except as provided in Contract article section 11.13.2, the District assumes no liability or responsibility for personal belongings or materials which may be lost, stolen or damaged.
